Tuition Refund Policy

It is understood there may be unplanned events which occur, causing a student’s pathway to change. This may mean the student must withdraw from the program of study. In order to avoid a decision being considered ‘subjective’ in nature, the reason for withdrawal must not be a consideration factor. It is only a matter of the student providing written notice to withdraw from a course and at what point he/she elects to do so.

A determining factor in the refund calculation will be the number of completed classes/hours within a scheduled subject. This is defined as the number of class hours that have been presented by the Academy and not the number of classes the student has attended in the subject, as at the date the notice of withdrawal is received by the Academy.

Due to the nature of various programs within the International Academy there are varied refund policies. Please ensure that you review the policy for the school division within which you are taking courses. In the International Academy of Traditional Chinese Medicine and the Natural Health Practitioners divisions, there are part-time programs and the refund policy for part-time subjects is calculated using a different formula from Full-time programs.

General Policy Procedures:

  • If a student withdraws, he/she is entitled to a refund under certain circumstances.
  • withdrawal from a program or subject must be advised to the Academy in writing. An email is acceptable as long as the email address is clearly identifiable to the student.
  • Verbal or telephone notification to any member of staff, faculty or other person will not be accepted.
  •  The student will continue to be considered as ‘enrolled/registered’ until such time that written notice is received.
  • The date for calculating the refund will be the date that the written notice is received by the International Academy of Applied Health Inc.
  • The Academy follows the generally accepted practices for withdrawal and refunds.
    The policy is described in detail in the full-time and Part-time student agreements within the International Academy of Massage and the International Academy of Traditional Chinese Medicine, a copy of which is provided to each student.
  • The principal objective of the policy is to be ‘equitable to all students’.

Note:
The refund section included in any signed student agreement will be the defined terms of reference for refund calculations for a student.

Key Points
The following key points will be helpful in understanding this policy:

  • Tuition fees are inclusive of any handouts, class notes and services provided by the Academy to the student body. There is no cash value to those items in a refund and nor does the Academy charge an additional amount for them if a student withdraws.
  • In the event the Student withdraws or is asked to leave by the Academy, the Student understands and agrees that he/she is financially obligated to the Academy for the appropriate amount of tuition fees.
  • Tuition fees are prepaid each semester or prior to the first class of the subject
  • If a student pays for a subject but elects not to attend all classes as presented, and does not withdraw, there is no partial refund for hours not taken and the number of hours presented and/or assigned for supervised home/on-site study, represents the basis for the calculation.
  • Refunds which are payable by the Academy will be issued to the student within 30 days of receipt of a withdrawal letter. They must be issued to the registered student and not to a third party.
  • A student in a full-time program who has been absent for 28 or more consecutive class days, will be determined to be ‘withdrawn’ without notice to the Academy.

For courses/subjects held at the International Academy of Applied Health Inc and are conducted by private contractors, who have rented the facilities, the refund policy will be specific to the contractor and the Academy is not responsible for refunds in any way.

 

International Academy of Massage Division

As the massage therapy program requires registration under the Private Career Colleges Act, 2005, the refund program follows the Act.

Fee Refund Policy as Prescribed under s. 25 to 33 of O.Reg. 415/06

A request to withdraw from a program must be made in writing, by registered letter, hand delivered letter, fax or email.

Full refunds

  1. (1) A private career college shall refund all of the fees paid by a student under a contract for the provision of a vocational program in the following circumstances:
  1. The contract is rescinded by a person within two days of receiving a copy of the contract in accordance with section 36 of the Act.
  2. The private career college discontinues the vocational program before the student completes the program, subject to subsection (2).
  3. The private career college charges or collects the fees,
    1. before the registration was issued for the college under the Act or before the vocational program was approved by the Superintendent, or
    2. before entering into a contract for the provision of the vocational program with the student, unless the fee is collected under subsection 44 (3).
  4. The private career college expels the student from the college in a manner or for reasons that are contrary to the college’s expulsion policy.
  5. The private career college employs an instructor who is not qualified to teach all or part of the program under section 41.
  6. The contract is rendered void under subsection 18 (2) or under section 22.
  7. If a private career college fails to, or does not accurately, provide in the itemized list provided to the Superintendent under section 43 a fee item corresponding to a fee paid by a student for the provision of a vocational program, the college shall pay the student,
    1. in the case of an item not provided by the college, the full amount of the fee for the item, and
    2. in the case of a fee in excess of the amount of the fee provided for the item, the difference between the amount of the fee for the item provided to the Superintendent and the fee collected.

(2) A full refund is not payable in the circumstances described in paragraph 2 of subsection (1) if the discontinuance of the vocational program coincides with the private career college ceasing to operate.

(3) A refund is not payable under paragraphs 1 to 6 of subsection (1) unless the student gives the private career college a written demand for the refund.

(4) A refund under subsection (1) is payable by the private career college within 30 days of the day the student delivers to the college,

  1. in the case of a rescission under section 36 of the Act, notice of the rescission; or
  2. in the case of a refund under paragraphs 2 to 6 of subsection (1), a written demand for the refund.

Partial refund where student does not commence program

  1. (1) If a student is admitted to a vocational program, pays fees to the private career college in respect of the program and subsequently does not commence the program, the college shall refund part of the fees paid by the student in the following circumstances:
  1. The student gives the college notice that he or she is withdrawing from the program before the day the vocational program commences.
  2. In the case of a student who is admitted to a vocational program on the condition that the student meet specified admission requirements before the day the program commences, the student fails to meet the requirements before that day.
  3. The student does not attend the program during the first 14 days that follow the day the program commenced and the college gives written notice to the student that it is cancelling the contract no later than 45 days after the day the program has commenced.

(2) The amount of a refund under subsection (1) shall be an amount that is equal to the full amount paid by the student for the vocational program, less an amount equal to the lesser of 20 per cent of the full amount of the fee and $500.

(3) A refund under subsection (1) is payable,

  1. in the case of a refund under paragraph 1 of subsection (1), within 30 days of the day the student gives notice of withdrawing from the program;
  2. in the case of a refund under paragraph 2 of subsection (1), within 30 days of the day the vocational program commences; and
  3. in the case of a refund under paragraph 3 of subsection (1), within 45 days of the day the vocational program commences.

(4) For the purposes of paragraph 3 of subsection (1), it is a condition of a contract for the provision of a vocational program that the private career college may cancel the contract within 45 days of the day the vocational program commences if the person who entered the contract with the college fails to attend the program during the 14 days that follow the day the vocational program commences.

(5) A private career college that wishes to cancel a contract in accordance with subsection (4) shall give written notice of the cancellation to the other party to the contract within 45 days of the day the vocational program commences.

Partial refunds: withdrawals and expulsions after program commenced

  1. (1) A private career college shall give a student who commences a vocational program a refund of part of the fees paid in respect of the program if, at a time during the program determined under subsection (3),
  1. the student withdraws from the program after the program has commenced; or
  2. the student is expelled from the program in circumstances where the expulsion is permitted under the private career college’s expulsion policy.

(2) This section does not apply to vocational programs described in sections 28 and 29.

(3) A private career college shall pay a partial refund under this section only if the withdrawal or expulsion from the vocational program occurs at a time during the program determined in accordance with the following rules:

  1. In the case of a vocational program that is less than 12 months in duration, the withdrawal or expulsion occurs during the first half of the program.
  2. In the case of a vocational program that is 12 months or more in duration,
    1. for the first 12 months in the duration of the program and for every subsequent full 12 months in the program, the withdrawal or expulsion occurs during the first six months of that 12-month period, and
    2. for any period in the duration of the vocational program remaining after the last 12-month period referred to in subparagraph i has elapsed, the withdrawal or expulsion occurs in the first half of the period.

(4) If the student withdraws or is expelled from a vocational program within the first half of a period referred to in subsection (3), the amount of the refund that the private career college shall pay the student shall be equal to the full amount of the fees paid in respect of the program less,

  1. an amount that is equal to the lesser of 20 per cent of the full amount of the fees in respect of the program and $500; and
  2. the portion of the fees in respect of the portion of the period that had elapsed at the time of the withdrawal or expulsion.

(5) If the student withdraws or is expelled from a vocational program during the second half of a period referred to in subsection (3), the private career college is not required to pay the student any refund in respect of that period.

(6) A private career college shall refund the full amount of fees paid in respect of a period that had not yet commenced at the time of the withdrawal or expulsion.

Partial refunds: distance education programs

  1. (1) This section applies to a vocational program that is offered by mail, on the internet or by other similar means.

(2) A private career college shall give a student who commences a vocational program referred to in subsection (1) a refund of part of the fees paid in respect of the program if,

  1. the student withdraws from the program or the student is expelled from the program in circumstances where the expulsion is permitted under the private career college’s expulsion policy; and
  2. at the time of the withdrawal or expulsion, the student has not submitted to the private career college all examinations that are required in order to complete the program.

(3) The amount of the refund that a private career college shall give a student under subsection (1) shall be determined in accordance with the following rules:

  1. Determine the total number of segments in the vocational program for which an evaluation is required.
  2. Of the total number of program segments determined under paragraph 1, determine the number of segments in respect of which an evaluation has been returned to the student.
  3. The amount of the refund that the private career college shall pay the student shall be equal to the full amount of the fees paid in respect of the program less,
    1. an amount that is equal to the lesser of 20 per cent of the full amount of the fees in respect of the program and $500, and
    2. the portion of the fees in respect of the number of segments determined under paragraph 2.

(4) A private career college is not required to give a student any refund if the student, at the time of withdrawal or expulsion, has been evaluated in respect of more than half of the total number of segments in the program.

Partial refunds: non-continuous programs

  1. (1) This section applies to a vocational program approved by the Superintendent to be provided through a fixed number of hours of instruction over an indeterminate period of time.

(2) A private career college shall give a student who commences a vocational program referred to in subsection (1) a refund of part of the fees paid in respect of the program if, before completing the required number of hours of instruction,

  1. the student has given the college notice that he or she is withdrawing from the program; or
  2. the student is expelled from the program in circumstances where the expulsion is permitted under the private career college’s expulsion policy.

(3) The amount of the refund that a private career college shall give a student under subsection (1) shall be equal to the full amount of the fees paid in respect of the program less,

  1. an amount that is equal to the lesser of 20 per cent of the full amount of the fees in respect of the program and $500; and
  2. a portion of the fees in respect of the program that is proportional to the number of hours of instruction that have elapsed at the time of the withdrawal or expulsion.

(4) A private career college is not required to give a student any refund if the student, at the time of withdrawal or expulsion, has completed more than half of the required number of hours of instruction in a program.

No retention of refund

  1. A private career college shall not retain, by way of deduction or set-off, any refund of fees payable to a student under sections 25 to 29 in order to recover an amount owed by the student in respect of any service or program other than a vocational program offered by the private career college.

Treatment of books and equipment

  1. In calculating a refund under sections 25 to 29, a private career college may retain the retail cost of books or equipment that the private career college supplied to the student if the student,
  1. fails to return the books or equipment to the private career college within 10 days of the student’s withdrawal or expulsion from the program, or
  2. returns the books or equipment to the private career college within the 10-day period referred to clause (a), but fails to return it unopened or in the same state it was in when supplied.

Refund for international students

  1. A notice to a private career college that is provided by or on behalf of an international student or of a prospective international student and that states that the student has not been issued a temporary resident visa as a member of the student class under the Immigration and Refugee Protection Act (Canada) is deemed to be,
  1. notice of a rescission of the contract for the purposes of section 36 of the Act if the notice is given within two days of receiving a copy of the contract; and
  2. notice that the student is withdrawing from the program for the purposes of paragraph 1 of subsection 26 (1) or clause 29 (2) (a) if the notice is received on or before half of the duration of the program has elapsed.

Currency

  1. Any refund of fees that a private career college is required to pay under the Act shall be paid in Canadian dollars.

International Academy of Traditional Chinese Medicine

These programs do not require registration under the Private Career Colleges Act, 2005.

The following key points will be helpful in understanding the policy for Full-time students:

  • If the student has been accepted into a program and has paid tuition fees to the Academy, in respect of the program and subsequently, withdraws within 14 days prior to the program’s commencement or does not commence the program; the amount of a refund shall be an amount that is equal to the full amount paid by the student for the program, less an amount equal to the lesser of 20 per cent of the full amount of the tuition fee for the program and $500.
  • If a student withdraws at anytime after the start of the program, the refund will be based on the timing of the withdrawal and the number of weeks of classes presented in the semester at the date of withdrawal. An amount of $500.00 will be added into the calculation to determine the amount of tuition refundable or payable by the student. This is subject to the following timing for the withdrawal as follows:

If the student withdraws during months 1 to 6 (inclusive).

The withdrawal calculation is pro-rated to the number of weeks presented to the effective date of withdrawal within the semester, based upon the number of weeks in the semester and the paid tuition for the semester; plus the $500.00 withdrawal fee,.

  • g. if a student withdraws at the end of month 5 and had paid the full semester fee of $2,890 he/she would receive a tuition refund of approximately $463.00
  • During months 7 to 12 (inclusive) the student is responsible for the tuition fees payable for this entire period, plus the $500.00 withdrawal fee. e.g. if a student withdraws at the end of month 10, he/she is responsible for the tuition for months,11 & 12 plus $500.00. If the student had fully paid for semester 4, he/she would be assessed a further $500.00.
  • During months 13 to 18 (inclusive) the withdrawal calculation is pro-rated to the number of weeks presented to the effective date of withdrawal, plus the $500.00 withdrawal tuition fee, based upon the paid tuition and number of weeks in the semester.
  • During months 19 to 23 (inclusive) the student is responsible for the tuition fees payable for this remaining period, plus the $500.00 withdrawal fee.

 

For TCM Part-time students the policy of the division International Academy of Natural Health Practitioners is utilized.

 

International Academy of Natural Health Practitioners

These programs do not require registration under the Private Career Colleges Act, 2005.

Part-time students generally take individual subjects or a small group of subjects each semester. Each subject is treated as an individual subject for refund calculation purposes.

Non-vocational and continued education units of study:

Withdrawal is:

  • Prior to 7 days before the start of a subject:
    • Tuition Fee: – Full refund or transfer of financial credit, as selected by the student less 10% of the fee paid.
    • Textbooks, full refund less a 10% restocking charge, providing they are returned in their original condition without markings or student name, within 10 days of the withdrawal.
  • Withdrawal within 7 days of the start of a semester: The refund will be the amount of the tuition fees paid, less 20% (up to a maximum of $500.00).
    • Textbooks, full refund less a 10% restocking charge, providing they are returned in their original condition without markings or student name, within 10 days of the withdrawal.
  • Withdrawal after the start of a semester:
    • If less than 50% of the hours for a scheduled subject have been presented as scheduled to the time of withdrawal:
      • the refund will be calculated on the prorated number of hours presented to the time of withdrawal plus a withdrawal fee of 20% of the tuition paid for the subject plus a prorated amount for a minimum of the first class in the semester.
    • If a student has registered for more than 1 subject in the semester, the maximum accumulative withdrawal fee will be $500.
  • If more than 50% of the hours of a scheduled subject have been presented  at  the time of withdrawal:
    • there is no refund payable – generally this would be at the start of class 6 in a 12 class subject, being taught in 2 hour classes.
    • Textbooks purchased from the Academy and returned in their original condition within 10 days of a withdrawal, will be refunded subject to a 10% restocking charge.

 Examples:

Example 1:

Student withdraws after 4 classes of a scheduled 12 class subject and the tuition fee was $287.

  • The student refund would be calculated as follows:
    1. 4/12= .33% of the course. $287 x.33=$94.71
    2. Withdrawal Fee = 20% of Tuition Fee. $287 x.20 =$57.40
  • Refund to student would be:
    $287.00 less $94.71, less $57.40=$134.89

Example 2:

A student is taking 6 subjects and has paid for the 6 subjects at the start of the semester. He/she withdraws from the subjects after 1 month:

  • At this time the student will have completed 33% of the subjects.
    • Tuition Fee Paid: 6x$287= $1,722.00
    • Pro-rated amount payable: $1722 x .33= $568.26
    • plus 20% withdrawal fee: $1722 x.20= $344.40
  • The refund due to the student will be: $809.34

Example 3:

Student attends some part of the first day of a 2 day course comprising 12 hours, does not withdraw in writing on day 1 and elects not to attend day 2: – no refund would apply.

Example 4:
The Academy has presented more than 50% of the scheduled subject hours – no refund would apply.

Meridian Educational Network Subjects

  • Refund Policy:

Withdrawal from a unit of study must be advised in writing, by letter, fax or email to the Administrator, admin@intlacademy.com, within the first 90 days of issuance. A student is eligible for a partial refund until such time the first of the required assignments for grading has been submitted or the unit of study has been issued to the student for 3 months, whichever occurs first. The refund will be calculated as follows:

  • Amount paid by the student for the unit of study, less $80.00 for materials=net
  • If the withdrawal letter is received within 90 days and no assignment has been completed, the refund will be the ‘net tuition’ amount less 20%
  • If the withdrawal is received within 90 days and the first assignment has been submitted, there is no refund.

If no written notice of withdrawal is received or the notice is received after 90 days of issuance, there is no refund.
